Why Homebuyers Need a Real Estate Attorney
Massachusetts is a caveat emptor state for real estate transactions, which essentially means “buyer beware.” Because of this, buyers have to be ready to perform an immense amount of research in regards to purchasing property. If a new owner finds out after a purchase that the basement floods or that the roof leaks, he has no recourse against the seller and will be left with the cost of making those needed repairs.
But that doesn’t mean that sellers don’t have any obligations to a buyer. In Massachusetts, sellers are required to tell buyers about the presence of lead paint in a home that was built before 1978, and if there is a septic system on the property, sellers are required to give the buyer a Title 5 Certificate indicating that the system is up to standards and that it has passed inspection.

Massachusetts, the Attorney State
Massachusetts is considered an “attorney state” in residential real estate transactions. This means that both buyers and sellers need a lawyer representing them during the transaction. This is unlike other states, in which real estate transactions only involve a buyer, seller, real estate agent, and a title company.
Sellers and buyers will be able to use the bank’s attorney if they do not have one of their own. Lawyers for the bank will be representing the bank’s best interests, while an attorney hired by the seller or buyer will be able to represent those interests alone.
An attorney will be able to negotiate and prepare an offer to purchase, as well as advise on an offer to purchase and the clauses within it. An attorney can also help sellers in the purchase of their new home after the sale, and can assist both buyers and sellers should issues arise during the offer stage. An attorney can also help with the mortgage process and help buyers understand what the commitment letter from a lender states.
