Premises Liability (Negligently Maintained Ramp) – Employee Was Delivering Liquid Nitrogen Tanks and Suffered
Shoulder Injury
The plaintiff was delivering liquid nitrogen and had to go up a ramp that had cracks in the pavement. As he was
pulling the dolly, he felt a pull in his shoulder and collapsed to the floor in excruciating pain. He was placed
on lighter duties after X-Rays and being placed in a sling.
As a result of the accident, the plaintiff had a SLAP tear in his shoulder and could no longer perform the same
duties he had previously been doing. This put financial and social strain on the plaintiff’s mental health as
well as continued pain and suffering due to lack of physical ability. He underwent physical therapy to attempt
to rehabilitate his shoulder and return to a normal work load.
